Guidance for to unemployment insurance.

Decree 61/2020 / ND-CP new guidance on cases of employees identified as being paid unemployment insurance include:

– The employee has paid unemployment insurance for the month of terminating the labor contract (labor contract), working contract (labor contract) or of the month preceding the month of terminating the labor contract and working contract;

– The employee has the month preceding the month of terminating the labor contract, the labor contract or the month of terminating the labor contract or labor contract which falls into one of the following cases:

+ Taking leave due to sickness and maternity benefits from 14 working days or more in a month, without receiving monthly salary at the company;

+ Unpaid leave from 14 working days or more per month at the company (currently not regulated);

+ Temporarily delay the implementation of labor contracts or working contracts from 14 working days or more per month at the company.

All the above cases must be certified by the social insurance agency on the social insurance book.

In addition, Decree 61 also amends and supplements regulations on dossiers of application for unemployment benefits.

Decree No. 61/2020/ND-CP takes effect from July 15, 2020.
