NEW LEGAL REQUIREMENTS
Decree No. 274/2025/ND-CP on Elaboration of the Law on Social Insurance Regarding Late Payment and Evasion of Compulsory Social Insurance and Unemployment Insurance; Complaints and Denunciations about Social Insurance
The newly issued Decree provides detailed guidance on the handling of late payments and evasion of compulsory social insurance and unemployment insurance contributions, as well as procedures for complaints and denunciations related to social insurance, in accordance with the Law on Social Insurance.
Under the Decree, the social security agency directly overseeing entities participating in compulsory social and unemployment insurance is required to conduct monthly reviews to determine the amount and duration of late payments or evaded contributions. Based on these findings, the agency will calculate the payable amount at a rate of 0.03% per day on the overdue or evaded sum, notify the employer for verification, and organize collection and management in compliance with legal regulations.
The Decree also specifies cases that are not considered evasion of compulsory social and unemployment insurance contributions. In line with Clause 1, Article 39 of the Law on Social Insurance, exemptions apply when delays result from force majeure events officially announced by competent authorities, including:
– Natural disasters such as storms, floods, inundations, earthquakes, major fires, prolonged droughts, and other events that directly and severely disrupt production and business activities;
– Dangerous epidemics declared by competent regulatory agencies that significantly affect operations and the financial capacity of agencies, organizations, and employers;
– Emergencies as prescribed by law that arise unexpectedly and abruptly, impacting the normal operations of agencies, organizations, and employers;
– Other force majeure circumstances as stipulated under civil law.
